Cocktail Catering TERMS & CONDITIONS

By booking an event with Sugar Rims, the client acknowledges and accepts Sugar Rims’ Terms and Conditions.
To confirm a client’s booking with Sugar Rims, a completed booking form and deposit are required. Sugar Rims reserves the right to cancel the date of the event in the case that either of them has not been received.
 
BOOKING DEPOSITS
 
All of Sugar Rims’ bookings are subject to a 20% security deposit. This security deposit is always required, unless specified otherwise. Payment of this deposit signifies your agreement to Sugar Rims’ terms and conditions. This deposit secures the booking, staff members, beverages, mobile bar, preparation and related services needed for the event.
This can be paid either via direct deposit, or credit card. Kindly note that a 2% surcharge applies to any credit/debit card payment.
Once the security deposit is received, the booking will be confirmed and a confirmation email will be sent. Please be advised that after a booking deposit has been paid, Sugar Rims will unfortunately not accept a reduction in guest numbers no matter the circumstances of them not attending. However, an increase in guest numbers with an appropriate amount of notice given to Sugar Rims can be accepted.
FINAL PAYMENT
The final payment for the event includes the total cost for all services, including any parking fees or any other fees charged at Sugar Rims’ expense, as per quotation to the client. A final payment of the booking, where only a security deposit has been paid, has to be received by Sugar Rims via direct deposit or credit card payment no less than 14 days prior to the event date.
Sugar Rims also reserves the right to select any another payment agreement via phone or email.
Sugar Rims partners with both Tyro & Lightspeed in receiving payments pre, intra & post event via our work phone or tablet. Kindly note that a 2% surcharge applies to any credit/debit card payment.
     FINAL PAYMENT OF BAR TAB PACKAGE
The minimum spend for Sugar Rims’ BAR TAB Package is around $1400, depending on the location, date, booking duration, number of guests as well as drinks associated. The booking deposit of the minimum spend is required no less than 31 days prior to the event, unless specified differently. The rest of the amount is required no less than 14 days prior to the event.
If a client decides to extend the bar tab on the event date, Sugar Rims upholds the right to retain a client’s Driver’s License & Credit Card(s) before continuing to provide the event services.
In situations where the ‘Minimum Spend’ or ‘Booking Credit’ has been exceeded by guests ordering, the client of the event must make the final payment as soon as the event ends.
If the ‘Minimum Spend’ or ‘Booking Credit’ on the BAR TAB Package has not been reached, a refund back to the client would not occur, or be warranted. There are no circumstances where these terms can be changed.
Sugar Rims upholds the right to charge the client’s credit card on file and escalate the matter to police & legal authorities if an event’s client financial obligations are not met/fulfilled on the same day.
     FINAL PAYMENT OF CASH BAR PACKAGE
The minimum spend for Sugar Rims’ CASH BAR Package is around $1400, depending on the location, date, booking duration, number of guests as well as drinks associated. A 20% booking deposit of the minimum spend is required no less than 31 days prior to the event, unless specified differently. The booking deposit will be refunded after the event to the client of this booking deposit.
Please note that even though this is a CASH BAR Package, if the ‘Minimum Spend’ or ‘Booking Credit’ that was agreed on between Sugar Rims and the client has not been put through the bar by the time the event ends, the client will be liable to Sugar Rims for the difference and no alcohol will be left at the client’s event to cover the remainder. Sugar Rims reserves the right to use the client’s booking deposit to cover the shortfall.
Guests may not bring their own drinks/alcohol to a cash bar as it is a violation of liquor licensing laws and will incur additional charges.
If the event ends earlier than expected for any reason, the client is still liable to Sugar Rims for the minimum spend.
There are no circumstances where these terms can be changed.
Sugar Rims upholds the right to retain a client’s Driver’s License & Credit Card(s).
Sugar Rims upholds the right to charge the client’s credit card on file and escalate the matter to police & legal authorities if an event’s client financial obligations are not met/fulfilled on the same day.
     FINAL PAYMENT OF DRY BAR PACKAGE
The final payment for the DRY BAR Package is based on the final agreed service requirements as per the invoiced amount. If a client has more guests than the service package they have purchased or if the client has failed to obtain all the ingredients that are used to create the selected cocktails that the client has chosen, Sugar Rims is not responsible for the client’s guests having to wait for drinks, reduced service efficiency or receiving drinks that do not include all the ingredients.
It is not Sugar Rims’ responsibility if a client decides not to take Sugar Rims’ guidance and recommendation regarding the amount of ingredients to be purchased or the number of bar staff to be hired with respect to the number of guests attending the event. Sugar Rims is very proud of the efficiency and productivity of our staff members. However, we DO NOT expect to overwork our staff to get the drinks out faster either.
 
CANCELLATION POLICY
Unfortunately, no refund of booking deposit, sub-total or total will be accepted or processed, if a booking is cancelled with Sugar Rims. However, the booking deposit will be transformed into a valid credit to be used in another booking made by the exact same client.
In order for the credit to take effect, the next booking must be strictly made within 9 months from the date the funds were originally received from the cancelled booking.
Sugar Rims reserves the right to decline the new proposed date if that date is already booked in by other clients. Unfortunately, if the client does not wish to book in another date within 9 months from the original booking deposit received date, the security deposit that has been paid will not be refunded.
No matter the circumstances, Sugar Rims does not refund booking deposits or sub-total or total amounts paid.
Kindly understand that Sugar Rims, as all businesses in the hospitality industry, still has expenses, bills, and permanent employee wages to pay and when a client cancels their event, these bills still exist and have to be covered, and by a client cancelling their event, Sugar Rims could have booked it with another client.
When a client pays their booking deposit/payment, this means that the client agrees to Sugar Rims’ operational policies, including the booking form, the cancellation policy, as well as the terms and conditions. 
 
CANCELLATIONS DUE TO GOVERNMENT POLICY
The same cancellation policy, as stated in the section above, applies for any government related decision that may affect a booking date with us.
Unfortunately, it is not the responsibility of Sugar Rims if a client’s booking, that has been partially/fully paid, becomes affected due to government policy. Please refer to the ‘Cancellation Policy’ details in the section above for more information.
 
GUESTS & EVENT DETAIL CONFIRMATION
Sugar Rims’ will conduct a headcount during each event. If additional guests are determined to be present at the event, Sugar Rims reserves the right to use the security deposit or credit card details of the client to cover the cost of the additional guests at a price which may be higher than if booked before the client’s event.
In the case that guests that have been paid for on the day of the event, not turn up for any specific reason, the amount paid for these guests will not be refunded. There are no circumstances where these terms can be changed.
Sugar Rims may only agree to an increase in the number of guests attending an event once a booking has been created. Sugar Rims will unfortunately not accept a reduction in guest numbers no matter what the circumstance of them not attending.
Once the final payment is received by Sugar Rims, no refunds are permitted.
 
BROKEN AND/OR MISSING EQUIPMENT
Unless the glassware/equipment was broken by Sugar Rims’ staff, should any breakages or damages occur to the bar equipment, including glassware, platters, alcohol or any other type of equipment, the cost of replacing broken, stolen or lost items will be invoiced to the client.
Should glass(es) be found after Sugar Rims’ departure, Sugar Rims will not pay for the glassware to be returned to the office. Clients will be required to return the glass(es) themselves at their own expense.
The fee for a broken/missing glass, is $5 per glass. If a client fails to transfer the reimbursement amount within five (5) days, they will be charged a $25 late fee.
 
TRAVEL & PARKING
If a client’s event is outside of 40km from Berwick, Victoria, travel is calculated in their quote. In the case of relocating the event after booking, the cost of the client’s booking may increase.
Any associated parking fees will be invoiced to the client, post-event.
 
BEVERAGE SERVICE TIME-EXTENSIONS
Sugar Rims may agree for a time-extension at their own discretion and if Sugar Rims’ staff are able to extend.
A new ‘Minimum Spend’ or ‘Booking Credit’ will be discussed and approved with the client to grant this extension.
 
PRODUCT AVAILABILITY
If unexpected circumstances occur and Sugar Rims is unable to provide the agreed beverages and/or services, Sugar Rims reserves the right the adjust these in consultation with the client.
 
SITE, SECURITY AND SAFETY
It is the client’s responsibility to arrange any necessary precautions to protect their property against the operation of Sugar Rims’ services. Although all care is taken, Sugar Rims takes no responsibility for any damage caused during the set-up, operation and pack up of services and equipment. Sugar Rims does not hold responsibility for any damage caused to the clients’ floors, doors or any other fixtures.
The client is responsible for the location of the event as well as the safety of all people who are part of the event, including Sugar Rims’ staff members on the location and delivery of equipment by Sugar Rims’ staff members to the location.
Sugar Rims’ staff members use reasonable efforts to conform with all applicable legislation and standards related to maintaining safe work practices.
Sugar Rims follows and enforces the national guidelines on the Responsible Service of Alcohol at all times and reserves the right to refuse serving any guest who is drinking very fast, intoxicated, disorderly, on drugs or offensive or unreasonable. It is the ultimate responsibility of the client to ensure that their guests behave themselves in a well-ordered manner at all times.
Sugar Rims’ staff members are trained not to serve alcohol to persons under the age of 18 years. Sugar Rims reserves the right to ask a guest for an acceptable form of identification to make sure the guest is of the age of 18 years or older. Sugar Rims reserves the right to discontinue liquor service. Sugar Rims DOES NOT serve alcohol to minors even in the comfort of the client’s home.
Sugar Rims recommends that the client considers and arranges security for their functions (of at least 1 security provider for every 80 guests).
Sugar Rims does not tolerate abusive behaviour, bad manners, rudeness or intolerance to staff members prior to, during, or after any events at all. We understand that hosting an event may be stressful sometimes. However, it is very important that all parties treat one another with respect and appreciation at all times.
Sugar Rims DOES NOT tolerate the consumption of drugs on sites of any kind, whether it’s the client’s house, another private site or a public site. Sugar Rims’ prioritises the safety of staff members before anything else. Under no circumstances it is acceptable for a client and/or their guest(s) to intervene with staff members performing their jobs, demean or verbally/physically abuse Sugar Rims’ staff members. Sugar Rims’ and its staff perform the services with respect, politeness and kindness and expect nothing less in return.
If Sugar Rims’ staff members be subject to any of the above, including being exposed to the use of drugs on site, the possibility of theft, violence or any other threat to their safety or the safety of Sugar Rims’ stock and equipment, Sugar Rims reserves the right to cease service, take all stock and equipment and exit the site at any time during the event. 
If a situation like this occurs, Sugar Rims is not responsible for the client’s guests who are doing the right thing for not getting the full service provided. No payment or deposit is refundable in this case.
 
COMPLIANCE WITH LAWS
The liquor license that Sugar Rims holds allows the supply of services to the client under strict adherence to certain terms and conditions. Hence, the client agrees to ensure:
  • The client and the client’s guests are not permitted to provide alcoholic beverages or associated equipment without prior arrangement with Sugar Rims.
  • The client represents and declares that they, or their responsible person, is of legal age to purchase alcohol and any alcohol purchased from Sugar Rims becomes the responsibility of the client, including the responsibility to abide by the applicable laws governing the sale and supply of alcohol to others, which includes but is not limited to: (a) The responsible service of alcohol; (b) The serving of alcohol to minors; (c) Ensuring that they have all relevant licences and approvals for the sale or supply of alcohol at that particular location.
  • If the function is not in a private home or space, the client must ensure that an area will be set aside for the exclusive use of the persons who have booked the function and is attended only by the client and their guests; If the client causes Sugar Rims to breach any of the terms of its licences or any other laws or regulations, the client must indemnify Sugar Rims for any damage, fines, penalties or costs Sugar Rims incur including damage or economic loss related to any loss of Sugar Rims’ licences or breach of regulations or laws.
